Italian marines surrender passport in trial court

KOLLAM: The two Italian marines, facing murder charges in Kerala, Friday surrendered their passports at the trial court here within hours of returning to India after Christmas holidays at home.

The marines -- Massimiliano Latorre and Salvatore Girone -- drove to Kollam after arriving in Kochi to comply with the court direction that they should surrender their passports as soon as they returned to India.

As part of the procedures, the marines filed an affidavit before District and Sessions Judge P D Rajan stating they had not only kept their assurance to the court but had returned to India a few days earlier than the time-frame set by the court.

The marines also urged the court to return the Rs six crore bank guarantee submitted by them as part of the condition set by the Kerala High Court for allowing them to join their families in Italy for a few days.

The judge extended the residence permit of the marines upto May 13, 2013 and asked them to appear before the court on January 15 for further proceedings in the case.

On December 22, the marines had left for Rome after the Kerala High Court permitted them to go for Christmas for two weeks.
The marines were arrested on February 19 last for shooting to death two Indian fishermen -- Ajesh Binki (25) and Jelestine (45) from onboard merchant vessel 'Enrica Lexie' off Alapuzha coast, 'mistaking' them for Somali pirates.

Police ID suspect killed during NY subway shooting

New York: Two police officers shot and wounded during a gun battle on a New York City subway train have been released from the hospital, as authorities identified the man who opened fire and was later killed.

The subway shooting was the second of two Thursday involving New York City police officers, prompting Mayor Michael Bloomberg to criticise the top US gun lobbying group.

In the subway shooting, police said Peter Jourdan, 37, passed between subway cars while the train was moving, which is illegal, shortly before 7:30 pm local time Thursday.

As the train pulled into a Brooklyn station, plainclothes officers Michael Levay and Lukasz Kozicki asked Jourdan for his identification, and instead he pulled out a handgun and opened fire, police said.

Kozicki was struck three times and Levay had a graze wound to his back but was able to return fire, killing Jourdan, police said. A passenger also suffered a graze wound in the chaos, while others ran for cover on the platform when the gunfire erupted, police said.

There were no other injuries.

Jourdan, of Allentown, Pennsylvania, had been arrested at least seven other times, including once in Los Angeles for bringing a gun to court.

Both Levay, 27, and Kozicki, 32, were released from the hospital yesterday.

The subway violence occurred about an hour after another shooting involving a police officer. Off-duty Police Officer Juan Pichardo was shot in the thigh at his family's Bronx car dealership during a robbery at about 6:30 pm.

"In recent weeks, we've heard some people say that the only thing that stops a bad guy with a gun is a good guy with a gun. But sometimes the good guys get shot and sometimes, they are killed," Bloomberg told reporters Thursday.

Bloomberg is very outspoken on gun violence and has been critical of the National Rifle Association's suggestion last month that the solution to school shootings like the recent one in Newtown, Connecticut, should be addressed by putting an armed police officer in every school in the country.

The Newtown shooting killed 20 children, ages 6 and 7, along with six adults at the school.

In New York City last year, 11 officers were struck by gunfire on duty and one off-duty, though none were fatal.

The violence this week came after news of record low violent crime in the city. There were 418 murders in 2012, the lowest since reliable record keeping began in 1963. The previous low was 471, in 2009.

The Italians had also executed Rs six crore bank guarantee as directed by the Kerala High Court for allowing them to leave for two weeks.

The Kerala government had opposed the marines plea in the high court by saying it was a ruse to "smuggle them out" and would "torpedo" the ongoing trial.

Malala's father gets diplomatic job in Britain

London: The father of 15-year-old Pakistani teenaged rights activist Malala Yousafzai, who was shot in the head by the Taliban but survived, has been given a diplomatic job in Britain, a daily said Thursday.

Ziauddin Yousafzai has been appointed Pakistan's education attache at the consulate in Birmingham, sources told the Daily Mail.
The job is believed to be for up to three years and virtually guarantees Malala will remain in the country for that duration for medical treatment.
Malala was targeted by the Taliban for her campaign for girl's education in Pakistan.
In October last year, she was shot in the head in an assassination attempt. She was later flown to Britain for specialist treatment at Birmingham's Queen Elizabeth Hospital.
While recovering in hospital, she was visited by Pakistan President Asif Ali Zardari.
Her father thanked well-wishers for their support.
"She wants me to tell everyone how grateful she is and is amazed that men, women and children from across the world are interested in her well-being," Ziauddin was quoted as saying.
Malala's case drew worldwide attention. She made the shortlist for Time magazine's "Person of the Year" for 2012.

US drone kills Pakistani militant Mullah Nazir

Islamabad: Top Pakistani militant leader Mullah Nazir and five others have been killed in a US drone strike in Pakistan, BBC reported Thursday citing security officials.

Nazir and the others were killed when two missiles struck in the tribal district of South Waziristan, the officials added.
Nazir, who was wounded in a suicide bomb attack last November, had been accused of sending fighters to support the Afghan Taliban and fight foreign and pro-government troops.
According to reports, Mullah Nazir's deputy, Ratta Khan, was also killed in the attack.
It was not clear if early Thursday's drone strike had targeted a house or a car in Angoor Adda, near the capital of Wana, close to the Afghan border, BBC said.
Analysts say Mullah Nazir had formed an alliance with the government and opposed the Pakistani Taliban, with whom he was at odds since he advocated attacks on US forces in Afghanistan rather than Pakistani soldiers.
Earlier reports, which had not named Nazir, had put the casuslties between four and five.

Rape victim's father asks Centre to respect public sentiments

BALLIA/UTTAR PRADESH: Asking the Centre to make amendments in law to name the proposed new anti-rape law after his daughter, father of the Delhi gangrape victim today said it will be an honour to the girl and respect public sentiments.
"I want the revised anti-rape law to be in the name of my daughter. It will be an honour for her. If there is some problem in doing due to constitutional provisions, Centre could amend them. It will also be a respect of public sentiments", father of the 23-year-old Delhi gang-rape victim told reporters.
"We will be sad if the anti-rape law is not named after my daughter", he said.
Demanding timely justice for his daughter, the father said that he was satisfied with the Delhi Police action.
The father of the victim also demanded that the Uttar Pradesh government set up a hospital in his village stating that it was wish of his daughter to do so in this backward village.
The Home Ministry has given indications that the revised law, which is expected to be stringent and facilitate speedier justice, is unlikely to be named after the girl who died last Saturday after battling for life for nearly two weeks.
Union Minister Shashi Tharoor had favoured naming the revised anti-rape law after the victim.
Tharoor had got support from former Uttar Pradesh Chief Minister Mayawati for his proposal.
"If the family of the victim has given its approval to the law being named after the rape victim I have no objections to it," Mayawati had said, adding "The Central government should convene an all-party meeting and take a decision in consensus with everyone".

Charge sheet in Delhi gang-rape case likely today

NEW DELHI: The Delhi Police is likely to file the charge sheet in the gangrape-cum-murder case of a 23-year- old girl in court here on Thursday and will seek death penalty for the accused during the trial.

A senior police official said the charge sheet is expected to be filed against five of the six accused in the December 16 brutal gangrape and assault case of the girl, who died in a Singapore hospital on December 29.

The sixth person apprehended in the case has claimed that he is a minor and his case will be tried in Juvenile Justice Board. A separate police report will be sent to the Board after a bone test confirms that he is a minor.

"The charge sheet will be in e-format as we do usually," the official said.

Sources said that the main charge sheet will comprise 50 pages and will be accompanied by hundreds of pages of annexures.

Charges of gangrape, murder, kidnapping, criminal assault and robbery among other sections of IPC will be pressed against the accused.

The prosecution during the trial would demand death penalty for the five accused in connection with ghastly incident which stirred the conscience of the nation.

The Singapore doctor, who carried out the postmortem of rape victim, will be included as a witness by the police in its charge sheet, the sources said.

The male friend of the victim will be the main witness in the case while the Singapore doctor, who carried out the postmortem, and the Indian mission official who received her death certificate, would be asked to testify, they said.

Police sources had said that the six accused had also allegedly tried to mow the girl down under the bus after dumping her in south-west Delhi but her male friend had saved her from being crushed in the nick of time.

The victim, a paramedical student, was gang-raped in a moving bus, brutally assaulted and then thrown out of the vehicle along with her male friend, a software engineer, who was also thrashed.

The girl and her friend were returning from the Saket mall after watching a film Life of Pi and had boarded the chartered bus at Munirka for Dwarka not knowing it was plying illegally. The minor among the accused had called for passengers telling them that it was going towards their destination.

Arya murder case: accused Rajesh gets death sentence

THIRUVANANTHAPURAM: A Sessions Court here on Thursday sentenced to death a 28-year-old man, an autorickshaw driver, for raping and murdering a 15-year-old girl Arya V J, alias Cuckoo last year.

Principal Sessions Judge B Sudheendrakumar awarded death sentence to Rajesh Kumar, who was found guilty of multiple offences, including raping and murdering the girl at her residence at Vattappara near here on March 6, 2012.

The prosecution case was that Rajesh entered the victim's home on the pretext that he wanted some water and a screwdriver for repairing his autorickshaw, which got stopped on the road in front of the house.

The victim, who was preparing for the 10th standard examination at the time, was alone at home as her parents were away.

Rajesh then caught hold of the girl. After raping her, he strangled the girl and ran away from the spot after snatching a gold chain of the victim.

To their shock, the girl's parents found their child lying dead when they returned home.

Rajesh, a native of nearby Kattakkada, was arrested a week later.

The prosecution said the accused had committed rape, murder and robbery and submitted that the crime should be considered as rarest of the rare cases and maximum punishment be awarded to the accused.
